4 - EXISTING LAWS AND RULES

4.1 The basic legislation regulating development in Himachal Pradesh is the Himachal Pradesh Town and Country Planning Act, 1977. This act is applicable only on declared Planning Areas. Besides this, there is the Himachal Pradesh Municipal Act, 1994 and Himachal Pradesh Municipal Corporation Act,1994, which cover the urban areas of the State. Each urban local body has its own bye laws framed under the provisions of the Himachal Pradesh Municipal Act,1994.

4.2 The sale and purchase of property is regulated through the Indian Registration Act,1908. Other Acts governing land are the Himachal Pradesh Tenancy and Land Reforms Act,1972, Himachal Pradesh Ceiling on Land Holdings, Act 1972, Himachal Pradesh Village Common Lands Vesting and Utilization Act,1974, the Land Acqisition Act,1894 and Himachal Pradesh Holdings(Consolidation and Prevention of Fragmentation Act.) 1971.
